Terms of Service

In Short

Mapkeepr is a place-saving app. You sign in with Apple, save places, and organize them into collections. We keep it simple: don't misuse the service, and we'll do our best to keep it running and your data safe. These terms are the full version of that deal.

Who We Are

Mapkeepr is operated by Gregor Pichler, based in Linz, Austria. When these terms say "we", "us", or "Mapkeepr", they mean Gregor Pichler as the provider of the service.

What You Agree To

By using Mapkeepr — whether you create an account or not — you agree to these terms. If you don't agree, please don't use the app. You must be at least 16 years old to use Mapkeepr (in line with the EU General Data Protection Regulation). If you are under 16, you need the consent of a parent or legal guardian.

Your Account

Mapkeepr uses Sign in with Apple — we never see or store your Apple password. You are responsible for keeping your Apple ID secure. One account per person. If we notice misuse, we may suspend or delete your account after notifying you.

What You Can Do

• Save, organize, rate, and tag places.
• Share screenshots to extract places using AI.
• Create and share collections with other users.
• Follow other users and discover curated collections.

What You Must Not Do

• Use the app to harass, spam, or harm other users.
• Upload content that is illegal, offensive, or infringes on others' rights.
• Attempt to reverse-engineer, scrape, or interfere with the app or its servers.
• Create multiple accounts to circumvent free-tier limits.
• Use the service for any purpose that violates applicable law.

Your Content

The places you save, notes you write, and images you upload remain yours. By using Mapkeepr, you grant us a limited license to store, process, and display your content as needed to provide the service — for example, showing your shared collection to people you invited. We won't use your content for anything else.

When you share a screenshot for place extraction, the image is sent to OpenAI for analysis and discarded afterwards. We do not permanently store your screenshots.

Mapkeepr Pro

Mapkeepr offers a free tier and a paid subscription ("Mapkeepr Pro"). The free tier includes up to 3 screenshot extractions per month and up to 3 collections. Mapkeepr Pro removes these limits.

• Subscriptions are managed through Apple's App Store and are subject to Apple's terms.
• You can cancel anytime in your Apple ID settings. Cancellation takes effect at the end of the current billing period.
• Refunds are handled by Apple according to their refund policy.
• We reserve the right to change pricing. Existing subscribers will be notified before any price change takes effect.

Third-Party Services

Mapkeepr relies on third-party services to function. Place information comes from Google Places, screenshot analysis uses OpenAI, and subscriptions are handled by Apple and RevenueCat. We are not responsible for the availability, accuracy, or policies of these services. Their respective terms apply when their services are used through Mapkeepr.

Accuracy of Information

Place details (addresses, ratings, opening hours, photos) come from Google Places and AI-powered extraction. We do our best to provide accurate information, but we cannot guarantee it. Always verify important details (like opening hours or dietary information) independently before relying on them.

Availability & Changes

We aim to keep Mapkeepr running smoothly, but we cannot guarantee uninterrupted service. We may update, modify, or discontinue features at any time. If we make changes that significantly affect your use of the service, we will notify you in advance where reasonably possible.

Liability

To the extent permitted by Austrian and EU law:

• Mapkeepr is provided "as is". We make no warranties beyond what is required by mandatory consumer protection law.
• We are not liable for indirect, incidental, or consequential damages arising from your use of the app.
• We are liable for damages caused intentionally or through gross negligence. For slight negligence, our liability is limited to foreseeable, typical damages, except in cases of personal injury.
• Nothing in these terms limits your statutory rights as a consumer under EU or Austrian law (including the Austrian Consumer Protection Act — Konsumentenschutzgesetz, KSchG).

Data Protection

We take your privacy seriously. How we collect, use, and protect your data is described in our Privacy Policy. By using Mapkeepr, you acknowledge that you have read the Privacy Policy.

Right of Withdrawal (EU)

If you are a consumer in the European Union, you have the right to withdraw from a distance contract within 14 days without giving any reason. For in-app purchases and subscriptions made through Apple's App Store, the withdrawal is handled by Apple in accordance with their terms and applicable EU law.

Account Deletion

You can delete individual places, collections, and tags at any time within the app. To delete your entire account and all associated data, email us at privacy@mapkeepr.com. We will process your request within 30 days, in line with GDPR requirements.

Termination

You may stop using Mapkeepr at any time. We may suspend or terminate your access if you violate these terms, after giving you reasonable notice and an opportunity to remedy the issue where possible. Upon termination, your right to use the service ends, but you can still request deletion of your data.

Governing Law & Disputes

These terms are governed by Austrian law. If you are a consumer residing in the EU, you also benefit from any mandatory provisions of the law of your country of residence. Any disputes shall be subject to the jurisdiction of the competent courts in Linz, Austria — without prejudice to your right as an EU consumer to bring proceedings in the courts of your place of residence.

The European Commission provides an online dispute resolution platform. We are not obligated and generally not willing to participate in dispute resolution proceedings before a consumer arbitration body, but will consider it on a case-by-case basis.

Changes to These Terms

We may update these terms from time to time. If we make significant changes, we will notify you through the app or by email before they take effect. Continued use of Mapkeepr after the changes take effect constitutes your acceptance of the updated terms.
